Our principal office is in Arlington, Texas, but we file briefs in every Texas court of appeal. We also practice before the Fifth Circuit Court of Appeals and can gain permission to file briefs and argue in any other federal circuit.
We don’t believe that an appeal can be evaluated competently in an hour-long consultation. We prefer to speak with you over the phone after we’ve received the evaluation information requested below to ascertain the posture of your case and determine whether we might be a good fit for you. At that time, you can decide whether or not you’d like to engage us to perform an initial evaluation of your case. Typically, we’ll be able to reach some preliminary conclusions after spending a day or two reviewing your documents and conducting some preliminary legal research. We require a retainer in advance for this, generally calculated at the hourly rate for one or two days of attorney time, i.e., $3,000 to $6,000 (large cases may require more time).
After the initial assessment, we’ll provide you our conclusions. You may then decide whether you want to proceed with the appeal and whether you want to enlist our firm to prosecute it. Please know that this initial evaluation is just that, a preliminary assessment. Our conclusions may change after reading the entire trial record or conducting additional research. We may find new avenues which may improve your chances of success, or we may discover that the original theories aren’t worth pursuing.
Additionally, because we handle appeals from throughout Texas, there isn’t a real need for a face-to-face meeting (which is quite different from trial practice). We usually handle full appeals through the telephone, internet, and overnight mail. Indeed, we often never meet our clients in person.
